1. Parties & Acknowledgment
This Waiver and Release of Liability ("Agreement") is entered into by the parent or legal guardian (the "Undersigned") of the minor athlete identified in the registration form (the "Participant"), and Rising Stars Academy ("RSA"), its coaches, volunteers, staff, agents, host venues, and affiliated organizations (collectively, the "Released Parties").
By registering the Participant for any RSA camp, clinic, training session, or related event (collectively, "Activities"), the Undersigned acknowledges they are the parent or legal guardian of the Participant and have full legal authority to execute this Agreement on the Participant's behalf.
2. Assumption of Risk
The Undersigned understands that participation in athletic activities — including but not limited to football, basketball, soccer, conditioning drills, contact and non-contact training, running, jumping, throwing, catching, agility work, and use of athletic equipment — involves inherent and unavoidable risks of injury, including but not limited to:
- Sprains, strains, fractures, dislocations, and other musculoskeletal injuries
- Cuts, abrasions, contusions, and bruises
- Concussions, head, neck, and spinal injuries
- Heat-related illness, dehydration, and overexertion
- Permanent disability or, in rare cases, death
- Property damage or loss
The Undersigned voluntarily and knowingly assumes all such risks on behalf of the Participant, both known and unknown, and accepts personal responsibility for any injury, damage, or loss the Participant may sustain in connection with the Activities.
3. Release of Liability
In consideration of being permitted to participate in the Activities, the Undersigned, on behalf of themselves, the Participant, and their respective heirs, executors, administrators, successors, and assigns, hereby releases, waives, discharges, and covenants not to sue the Released Parties from any and all liability, claims, demands, actions, and causes of action whatsoever, arising out of or related to any loss, damage, or injury — including death — that may be sustained by the Participant during or as a result of the Activities, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.
4. Medical Authorization
The Undersigned authorizes RSA staff to seek and obtain emergency medical treatment for the Participant in the event of injury or illness during the Activities when the Undersigned cannot be reached in a timely manner. The Undersigned agrees to be financially responsible for all medical expenses incurred for or on behalf of the Participant.
The Undersigned represents that the Participant is in good physical condition and has no medical condition that would prevent safe participation in the Activities, except as disclosed on the registration form. The Undersigned agrees to update RSA promptly of any change in the Participant's medical status that may affect their ability to participate safely.
5. Code of Conduct
The Undersigned has reviewed the RSA Athlete Code of Conduct and agrees that the Participant will abide by it during all Activities. RSA reserves the right to dismiss any Participant whose conduct, in RSA's sole discretion, is detrimental to the safety, well-being, or experience of other Participants, coaches, volunteers, or host venues. No refund will be issued for dismissal based on conduct violations.
6. Indemnification
The Undersigned agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and expenses — including reasonable attorneys' fees — arising out of or resulting from the Participant's participation in the Activities, the Participant's violation of this Agreement, or the Participant's violation of the RSA Code of Conduct.
7. Photo & Media Release
Participation in the photo and video release is optional and indicated separately on the registration form. If the Undersigned has granted permission, RSA may photograph, film, or otherwise record the Participant during the Activities and use such media in promotional, marketing, or program-related materials including but not limited to the RSA website, social media, printed materials, and donor or sponsor communications, without compensation. The Undersigned may revoke this permission at any time by written notice via the contact form; revocation will apply to future use only.
8. Refunds & Cancellation
Camp fees are generally non-refundable once registration is confirmed. RSA reserves the right to cancel, reschedule, or modify any Activity due to weather, low enrollment, facility availability, or other circumstances beyond reasonable control. In the event of cancellation by RSA, fees paid will be either credited toward a future Activity or refunded at RSA's discretion. Withdrawal by the Participant for personal reasons is reviewed on a case-by-case basis.
9. Severability & Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles. Any dispute arising under this Agreement shall be brought exclusively in the state or federal courts located in Craven County, North Carolina.
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to render it enforceable while preserving the original intent of the parties.
10. Entire Agreement
This Agreement, together with the registration form and the RSA Code of Conduct, constitutes the entire agreement between the parties with respect to the Participant's involvement in the Activities and supersedes all prior agreements, representations, or understandings, whether written or oral.
Acknowledgment. By checking the "Liability Waiver" acknowledgment box during online registration and submitting the registration form, the Undersigned confirms that they have read this Agreement in full, understand its terms, and agree to be legally bound by it on behalf of themselves and the Participant. The electronic acknowledgment carries the same legal weight as a handwritten signature under applicable electronic signature laws.
